Terms & Conditions
Padel Farm
Fitness Membership & Booking Terms and Conditions
1. About these Terms
1.1These Terms and Conditions apply to Padel Farm fitness memberships, fitness class bookings and single class passes purchased or managed through ClubRight.
1.2In these Terms, “we”, “us”, “our” and “Padel Farm” refer to The Padel Farm Ltd. “You” and “member” refer to the person purchasing or using a membership, class booking or pass.
1.3By purchasing a membership or pass, or by booking or attending a fitness class, you agree to these Terms together with any applicable membership information and our Privacy Notice.
1.4If a specific offer or membership product has additional written conditions, those conditions will apply alongside these Terms. If there is a conflict, the specific written conditions for that product will take priority.
2. Eligibility and Membership Use
2.1Adult fitness classes are available to people aged 16 or over unless a class is specifically advertised for another age group.
2.2Memberships, passes and class bookings are personal to the named member and must not be transferred, shared or resold.
2.3We may ask for reasonable evidence of identity or eligibility for a particular membership or offer.
2.4Members must keep their ClubRight account and contact details accurate and up to date.
3. Membership Types and Class Access
3.1The classes included in a membership will be shown when you join. Unless stated otherwise, eligible Padel Farm fitness classes use the same membership access or allowance.
3.2Special events, workshops, courses, competitions, guest sessions or externally delivered sessions may be excluded from membership and charged separately.
3.3Membership does not guarantee a place in any particular class. All bookings remain subject to capacity and availability.
4. Early Bird Membership Rate
4.1Any Early Bird membership rate is valid for 12 months from the membership start date unless the offer states otherwise.
4.2At the end of the 12-month Early Bird period, the membership will move to the applicable standard membership rate. We will give members appropriate notice of the rate that will apply before it takes effect.
4.3If an Early Bird member cancels rather than freezes their membership, any preferential rate is not guaranteed if they later rejoin.
5. Membership Payments
5.1Membership fees are payable at the frequency and amount shown when you join.
5.2You are responsible for maintaining a valid payment method and ensuring payments can be collected when due.
5.3If a payment fails, we may contact you and may temporarily restrict booking or membership access until the outstanding amount is resolved.
5.4Any future price change will be communicated before it takes effect and will be handled in accordance with applicable consumer law and the terms of your membership.
6. Cooling-Off Rights for Online or Distance Purchases
6.1Where you purchase a membership or service online, by phone or otherwise at a distance and the statutory cooling-off rules apply, you normally have 14 days from the day the contract is entered into to cancel without giving a reason.
6.2If you ask us to begin providing services during the cooling-off period and then cancel within that period, we may be entitled to charge a proportionate amount for services already supplied, where the law allows this.
6.3Nothing in these Terms limits any statutory cancellation rights that apply to you.
7. Cancelling Membership
7.1Ongoing membership may be cancelled by giving one month’s notice.
7.2Notice must be given through the cancellation method made available by Padel Farm, for example through ClubRight or by contacting us at support@thepadelfarm.org
7.3Membership and access will continue during the notice period and fees falling due during that period remain payable.
7.4Cancellation does not affect any statutory rights you may have.
8. Freezing Membership
8.1We may allow a membership to be frozen for up to 3 months at one time, subject to approval and any eligibility rules that apply at the time.
8.2During an approved freeze, access to classes and membership benefits will normally be paused.
8.3Where we agree a freeze rather than a cancellation, the member may retain their existing or preferential membership rate on return, subject to the terms of the original offer.
8.4A freeze is not automatic. Members should contact us before the requested freeze date wherever reasonably possible.
9. Class Booking Window
9.1Classes may be booked up to 7 days in advance.
9.2Members and PAYG customers will initially have the same booking window unless a specific product states otherwise.
9.3Bookings are subject to availability and are not confirmed until shown as confirmed in ClubRight.
10. Class Cancellations by Members
10.1If you cannot attend a booked class, please cancel as soon as possible so the space can be offered to another customer.
10.2The standard cancellation window is 6 hours before the scheduled class start time.
10.3If you cancel at least 6 hours before the class, an eligible session credit or PAYG class credit will be returned to your account where applicable.
10.4If you cancel less than 6 hours before the class, the booking will be treated as a late cancellation. For session-based memberships or PAYG bookings, the session or pass will be lost and will not be refunded.
10.5A late cancellation is not a no-show and does not count as a strike under section 11.
11. No-Show and Three-Strike Policy
11.1A no-show occurs when you fail to attend a booked class and have not cancelled the booking before the class starts.
11.2The three-strike policy applies to no-shows only. Late cancellations do not count as strikes.
11.3First no-show within a rolling 30-day period: you will receive a friendly reminder.
11.4Second no-show within a rolling 30-day period: you will receive a warning that a further no-show may affect your advance booking privileges.
11.5Third no-show within a rolling 30-day period: your advance booking privileges will be suspended for 7 days.
11.6During the 7-day suspension, you may only book a class on the day it takes place, subject to availability.
11.7At the end of the 7-day suspension, normal advance booking privileges will automatically be reinstated.
11.8For session-based memberships or PAYG bookings, a no-show will also result in the booked session or pass being lost.
11.9We understand that unexpected circumstances happen. If exceptional circumstances prevent you from attending, contact the team as soon as possible. We may waive a strike or other consequence at our reasonable discretion.
12. Waitlists
12.1Where a class is full, a waitlist may be available.
12.2Waitlist places operate on the basis shown in ClubRight. If a place becomes available, it may be offered to customers on the waitlist in order of priority.
12.3Joining a waitlist does not guarantee a place in the class. You are responsible for checking whether your booking has been confirmed.
13. Full Membership Fair Use
13.1“Full” means there is no fixed weekly class allowance, but access remains subject to availability, these Terms and fair use.
13.2Full members may book a maximum of 1 fitness class per day unless we expressly allow otherwise.
13.3Members should only reserve classes they genuinely intend to attend and should cancel promptly if plans change.
13.4No-shows by unlimited members are managed under the three-strike policy in section 11.
14. Single Class Passes and PAYG
14.1Single class passes may be purchased where available.
14.2A single class pass is valid for 7 days from the date of purchase and must be used within that period.
14.3Single class passes are personal and non-transferable.
14.4If a PAYG booking is cancelled at least 6 hours before the class, the eligible class credit will be returned for use within its original validity period unless ClubRight or the offer states otherwise.
14.5If a PAYG booking is cancelled less than 6 hours before the class, or the customer is a no-show, the pass is lost and no refund is due, subject always to statutory rights.
15. Arrival and Late Entry
15.1Please arrive 5 to 10 minutes before your class, particularly if equipment setup or a safety briefing is required.
15.2Entry more than 5 minutes after the scheduled start time may be refused at the instructor’s reasonable discretion for safety and to avoid disrupting the class.
15.3If late entry is refused, the booking may be treated in the same way as a late cancellation unless the team decides otherwise in exceptional circumstances.
16. Changes or Cancellations by Padel Farm
16.1We may occasionally need to change an instructor, class format, time, location or other operational detail.
16.2An instructor change alone does not normally entitle a member to a refund or additional credit where the class still goes ahead substantially as advertised.
16.3If Padel Farm cancels a class, an eligible membership credit will be returned. PAYG customers will be offered a replacement credit or refund as appropriate.
16.4We will try to give as much notice as reasonably possible when a class is changed or cancelled.
17. Health, Fitness and Participation
17.1You are responsible for deciding whether a class is suitable for you and for participating within your own abilities.
17.2Before your first session, you may be asked to complete a health declaration or questionnaire.
17.3Please tell the instructor about any relevant injury, pregnancy, medical condition, restriction or other issue that could reasonably affect safe participation.
17.4Where appropriate, you should seek advice from a qualified medical professional before exercising.
17.5Instructors may adapt an exercise or reasonably ask you not to take part in all or part of a session where they believe participation would create an immediate safety risk.
18. Clothing, Footwear and Equipment
18.1You must wear suitable sports clothing and secure footwear appropriate to the class.
18.2You must follow reasonable instructor guidance on the safe setup and use of equipment.
18.3You must not intentionally misuse, damage or remove Padel Farm equipment.
19. Conduct
19.1Members and guests must treat staff, instructors and other customers with respect.
19.2Abusive, threatening, discriminatory, dangerous or persistently disruptive behaviour is not acceptable.
19.3We may require a person to leave a class where reasonably necessary for safety or the proper operation of the session.
19.4Serious or repeated breaches may lead to temporary suspension or termination of booking privileges or membership.
20. Phones, Filming and Photography
20.1Do not photograph or film other members or staff without their permission.
20.2Phones should not be used in a way that disrupts a class or creates a safety risk.
20.3Any consent for Padel Farm to use identifiable member photographs or video for marketing or social media will be handled separately from these Terms.
21. Personal Belongings
21.1Members are responsible for looking after their personal belongings and should use any storage facilities provided where appropriate.
21.2We are not responsible for loss or damage that we could not reasonably have prevented, but nothing in these Terms limits liability where it would be unlawful to do so.
22. Privacy and Communications
22.1We collect and use personal information needed to administer memberships, payments, bookings, attendance, safety and customer service.
22.2Health information will only be collected where reasonably necessary and will be handled in accordance with applicable data protection law and our Privacy Notice.
22.3Service communications, such as booking confirmations, cancellations, waitlist messages and important membership notices, may be sent using the contact details linked to your account.
22.4Marketing communications will be handled separately and in accordance with your marketing preferences and applicable law.
22.5Our Privacy Notice is available on the Privacy Policy tab.
23. Suspension or Termination by Padel Farm
23.1We may temporarily suspend access or, in serious cases, end a membership where there is a material or repeated breach of these Terms, non-payment, fraud, serious misconduct or a significant safety risk.
23.2Except where immediate action is reasonably required, we will normally explain the issue and give the member a reasonable opportunity to resolve it before ending membership.
23.3Any decision will be made reasonably and will not affect rights that cannot legally be excluded.
24. Our Responsibility to You
24.1We will provide our services with reasonable care and skill.
24.2Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.
24.3Nothing in these Terms affects your statutory rights as a consumer.
25. Changes to These Terms or Services
25.1We may make reasonable changes to these Terms or to operational rules where necessary, for example because of changes in law, safety requirements, technology, facilities or the way services are delivered.
25.2Where a change is material and affects an ongoing membership, we will provide reasonable notice before it takes effect and explain any options available to the member.
25.3We will not rely on this section to make changes that would be unfair under consumer law.
26. Complaints and Contact
26.1If you have a question, booking issue or complaint, please contact the Padel Farm team at support@thepadelfarm.org or using the contact method shown in ClubRight.
26.2We will aim to deal with concerns fairly and as promptly as reasonably possible.
26.3Our business address is The Padel Farm, Well Lane, Sutton-on-the-Forest, York YO61 1EE.
27. Governing Law
27.1These Terms are governed by the law of England and Wales, without affecting any mandatory consumer protections that apply to you.
27.2If a dispute cannot be resolved directly, the courts with jurisdiction under applicable consumer law may hear the dispute.
